After King v. Burwell, What’s Next?
…One question looming over any potential actions by states is how long the states would have to act. Normally, Supreme Court decisions take effect 25 days after they are issued. But G. William Hoagland, senior vice president of the Bipartisan Policy Center here, said while he recognizes it’s unprecedented in a situation like this one, he believes it’s possible the justices might grant a stay on the decision to give Congress time to enact a plan.
In the oral argument on the case before the Supreme Court, Justice Samuel Alito mentioned the possibility of delaying the decision. However, noted Simon Lazarus, JD, of the Constitutional Accountability Center here, who was also a panelist at the Alliance briefing, “No one else got on that bandwagon. So I would say it’s not terribly likely.”…
