History of the North Dakota Constitution Amicus Brief in Access Independent Health Services Inc., d/b/a Red River Women’s Clinic v. Wrigley
Amicus is the Constitutional Accountability Center, a think tank and public interest law firm dedicated to fulfilling the progressive promise of the U.S. Constitution’s text and history. The brief argues how the text and history of the North Dakota Constitution compel the conclusion that the Inalienable Rights Clause protects the right to abortion. Inspired by the powerful protections for individual rights in the U.S. Declaration of Independence, North Dakotans adopted a sweeping Inalienable Rights Clause in their state constitution. Amicus then outlines how the text, structure, and history of the North Dakota constitution protects the inalienable and fundamental right to reproductive autonomy.
